{"id":202,"date":"2010-10-27T16:13:04","date_gmt":"2010-10-27T21:13:04","guid":{"rendered":"http:\/\/gutcheckamerica.com\/?p=202"},"modified":"2010-10-28T13:59:37","modified_gmt":"2010-10-28T18:59:37","slug":"hot-art-gets-free-speech-legal-cheat-sheet","status":"publish","type":"post","link":"https:\/\/gutcheckamerica.com\/?p=202","title":{"rendered":"&#8216;Hot Art&#8217; Gets Free Speech Legal &#8216;Cheat Sheet&#8217;"},"content":{"rendered":"\n<p class=\"dropcap-first\">There is no shortage of controversial art.\u00a0 Entire <a href=\"http:\/\/www.pbs.org\/newshour\/bb\/entertainment\/july-dec99\/art_10-8.html art\" target=\"_blank\">cities have made the news<\/a> for refusing to install or hang a particular piece of.\u00a0 But such controversies don&#8217;t stop at the intersection of Real World and Cyberspace, they only become exacerbated owing to the &#8220;anywhere, everywhere&#8221; nature of the Net.<\/p>\n<p>Just how far does free speech extend into cyberspace (short answer: to infinity\u2026 and beyond!) and why does there seem to be a huge gap between what&#8217;s possible (under the law) and what is demanded by self-deputized &#8220;moral censors&#8221;?<\/p>\n<p>Well, today the <a href=\"http:\/\/www.cdt.org\" target=\"_blank\">Center for Democracy &amp; Technology<\/a> took the wraps off a new website called OnlineArtRights, which was created out of funding from the <a class=\"zem_slink\" title=\"Andy Warhol\" rel=\"wikipedia\" href=\"http:\/\/en.wikipedia.org\/wiki\/Andy_Warhol\">Andy Warhol<\/a> foundation.\u00a0 CDT blogged about the launch, saying:<\/p>\n<blockquote><p>[The site] provides information and resources covering the wide range of free speech issues \u2013 and <a class=\"zem_slink\" title=\"First Amendment to the United States Constitution\" rel=\"wikipedia\" href=\"http:\/\/en.wikipedia.org\/wiki\/First_Amendment_to_the_United_States_Constitution\">First Amendment<\/a> protections \u2013 artists may encounter when they post their work on the web.<\/p>\n<p>The site is divided into three categories that are designed to respond to different questions. The Issues section of the site walks through the laws surrounding different types of content that might appear in an artist\u2019s work, covering everything from sex and violence to satire and remix. If you\u2019re looking for a quick run-down of the key points, check out the What You Need to Know page for each issue. The Basics provides a complete introduction to the topic, while Laws, Cases, and Other Resources is where you\u2019ll find a full legal analysis of each issue, with links to key laws and cases.
